1. ABOUT TERMS

Your247Host.com provides web hosting to users from around the world, and has the responsibility to protect each and every client also to provide top quality service. The acceptable use policy and the terms of service are designed to provide the client base of Your247Host a clear understanding of what we expect from our customers as they use our service. All clients MUST follow all the terms mentioned below or it could result in penalties / suspension.

2. USER AGREEMENT

You agree to use all services & facilities we provide at your own risk. Upon becoming a client you agree that Your247Host.com is harmless from any and all liabilities, losses, and claims which also include responsible attorney held against Your247Host.com. Clients agree that Your247Host.com is held harmless against any liability arising out of injury to person or property caused by our products. Your247Host.com reserves the rights to intervene to any service hosted on its servers in the interest and safety of content for its customers. If websites are found or reported with content that abuses our terms, action will be taken into consideration.

Your247Host.com will not take any editorial control over a website, E-Mails, and Newsgroups or any other online material hosted. However according to our terms we reserve the right to remove materials / files that is in our sole discretion, that may be illegal or subject in making us liable and violates our Terms. We support the uncensored flow of data, information, and ideas over the World Wide Web (WWW), and we do not actively monitor subscriber activity under normal circumstances.

3. LEGAL AGREEMENT

Your247Host.com has rights to co-operate with legal authorities in the investigation in any suspected or alleged crime or civil lawful violation. Your violation to this AUP or to any lawful crime will result in immediate Suspension of account / Termination of account.  At no time will Your247Host.com co-operate in any illegal actions.

4. BILLING

Your247Host.com billing sequences are as followed: - Monthly, Semi-Annually and Annually, which are available on most packages. If you the client is not satisfied with our services and the packages which you have bought then we will offer a 30-Day Money back Guarantee (Dose not include Special offer Packages). The 30-Day Money back Guarantee is only subjected to those who purchase a package and have a valid reason to leave. Domain registration fees are non-refundable. All payments are made through PayPal, Moneybookers, Liberty Reserve, and Google Checkout (Google checkout orders can take up to 24 Hours to be activated). All the mentioned checkouts are secure merchant gateways, which also include refund options. Accounts are usually activated as soon as the payment is received however this can vary in some circumstances.

Late Payments, All clients will be billed from the date they were activated on. If the payment for the following period is not paid, an e-mail will be sent warning of the account being suspended within 5 days from that date if the payment is not made, failure to make the payment within these 5 days will then result in suspension of account, which is liable for a fine, a further failure to make a payment within the following 30 days of this will then result in account termination (this is permanent extermination of the account, all data will be removed from the servers).

5. DOMAINS

Any domain purchased by a client from Your247Host.com is owned by Your247Host.com. If at any time the client wishes to leave the service, the domain can remain registered with Your247Host.com if registration payments are maintained, however the client can also request to transfer the domain.

6. CPANEL REQUESTS

Any request made does not have to be fulfilled by Your247Host.com staff. Requests are made because the client should need the feature requested, some requests may incur charges, any charges will be informed to the client before the request is completed and the request will only be completed once the client has confirmed those charges should the client incur any.

7. ACCEPTABLE USE POLICY

All services provided by Your247Host.com can and will only be used for lawful purposes. Transmission, storage and presentation of content and information which violates any federal state / city laws is prohibited. The acceptable use policy is strictly enforced.  If a client is discovered offending users with content and offending staff they will be removed as soon as discovered. Any type of child pornography is strongly prohibited on Your247Host.com Servers and will result in being instantly terminated from the service. If unsure of if what you are hosting violates the terms then do not hesitate to contact us via support ticket to find out.

Your247Host.com Reserves the right to determine whether what is hosted is acceptable for our servers. Subscribers to our services agree that the company is not liable for any damage which is beyond the company control. In no event shall the company be liable for special consequential damages which result in loss or injury. Your247Host.com is committed to a principle of freedom of speech; certain activity that may damage, insult the public or damage resources for both Your247Host.com and the World Wide Web (WWW) is prohibited on the guise of freedom of speech.

Audio and Video content can only be hosted if the client is the creator, and the owner of the Copyright for the file. The Client MUST have the rights to distribute audio / video hosted on the services, evidence will be required on request.

All the following scripts are banned from our servers. The reason for this is because they take heavier server load and can be an invitation to Hackers and Spammers.

11. WARNING & SUSPENSION POLICY

If we find any customer or user violating item in the terms they will be issued with a warning. If problem persists and problem has not been solved by the client then a second warning is issued and a suspensions for 5 days. After 5 days if the problem persists on clients account, client will be given 48 hours to backup their website and their account will be terminated. Emails will be sent if you reach these stages.

If accounts are suspended, all clients are applied to a one off suspension fee; once this fee is paid clients’ accounts will be unsuspended. The un-suspension fee currently stands at $5 per un-suspension. This fee is paid in order to retrieve your files, or just to un-suspend an account and to continue with us.

12. REFUND POLICY

Standard packages which we always offer all have a 30-Day money back guarantee if the user is not pleased with the service we provide (Reason for leaving is required and must me valid). If at anytime we find customers violating terms they will not at anytime be issues with any type of refund (Included in the 30-day money back guarantee). All domains are non refundable once purchased. Our team can choose to give a client a refund. Subscriptions are only refundable if the client still has hosting with is and wishes to cancel. If the subscription is not cancelled post to hosting being terminated and another payment has been initiated the client is not eligible for a refund. (We, Your247host cannot cancel PayPal subscriptions at any time its up to the client to control there subscriptions and cancel them once the hosting has been terminated)

13. DISCLAIMER

Your247Host.com is not held liable for system Downtimes, Crashes and data loss. The company cannot be held liable for predicted costs which a clients or customer would have estimated if there website was running. Services held by Your247Hot.com are resold. Some content of the website, portals and programmers used are not directly owned or written by Your247Host.com. We reserve the rights to terminate any account if terms are not followed. Your247Host.com has the rights to edit, modify, erect and delete content of the terms and condition which include the above guidelines, warning and disclaimer.
